These terms of use apply to purchases on vertical-unit.com and to your use of our website. Vertical Unit is a registered trademark of KW Enterprises GmbH, a Swiss company with the registration number CHE-394.242.670 (referred to as “Vertical Unit”).

If these terms contradict the information on the Shipping & returns page, the information on that page takes precedence.

CONFIRMATION

As soon as we have received your order, we will send an electronic invoice to your email address as confirmation of your purchase. It is important that you enter the correct email address when ordering. We recommend that you keep this email to make future contact with customer service easier. The order confirmation also serves as proof of purchase.

PAYMENT

You can pay by credit and debit card, with PayPal, with Klarna and with Apple Pay and Google Pay. The payment methods available to you in each case are shown during checkout, and what is shown there is binding. Vertical Unit does not store any credit card numbers. No surcharge is made for card payments. If no payment has been received after you submit your order, Vertical Unit may cancel your order automatically. All products remain the property of Vertical Unit until paid in full.

PROMO CODES

Promo codes must be entered during checkout to be valid. They cannot be added after the purchase.

TAXES

All prices shown on the website include VAT in accordance with the applicable legislation. Deliveries to the European Union are made duties and taxes paid; no further fees are due on delivery. For delivery addresses outside Switzerland, Liechtenstein and the European Union, import duties and taxes may be charged when the shipment arrives. These are your responsibility. Vertical Unit has no influence over such charges and cannot predict their amount; please contact your local customs office for information.

ORDERS AND RETURNS

Vertical Unit reserves the right to change prices and to correct incorrect prices on orders. If a price is incorrect, Vertical Unit may cancel the purchase and refund the amount paid.

Consumers have the right to return the order within 30 days of receipt. This right applies provided that the product and its original packaging can be returned in the condition in which they were received. Please contact Vertical Unit before sending a return to obtain the return address.

Who bears the return costs is governed by the Shipping & returns page: for delivery addresses in Switzerland and Liechtenstein, Vertical Unit covers the return. For delivery addresses in the European Union, you bear the direct cost of returning the goods; the statutory fourteen-day right of withdrawal also applies there, as set out in full in the information on the right of withdrawal on that page.

If an item is damaged in transit, contact Vertical Unit within 30 days for information about compensation.

PERSONAL DATA

When you shop at Vertical Unit, we store some of your data in order to complete your purchase. Vertical Unit treats all personal data confidentially. You have the right to request information about your data and to have incorrect data corrected or deleted. Vertical Unit may use cookies, for example to improve the use of the website. Details can be found in our Privacy policy.

PRODUCT

Vertical Unit has the right to adjust prices and to change product information such as product images and offers without prior notice. The available product images and information texts depict the product as accurately as possible. We cannot guarantee that all images reproduce the appearance of the product exactly; the display may vary depending on the colour settings of your screen.

DELIVERY AND CANCELLATIONS

Deliveries are made in cooperation with Swiss Post and its partners. You have the right to cancel purchases and return delivered goods by contacting Vertical Unit customer service within 30 days of receiving the goods, provided that the goods, including their packaging, are in the same condition as when received.

If, as a customer, you believe that delivery is delayed to such an extent that you no longer wish to proceed with the order, it is your responsibility to cancel the order. If the order has already been shipped, it must be accepted. A cancellation is only valid once it has been confirmed to Vertical Unit in writing or by email. If a product has been discontinued, Vertical Unit has the right to cancel the purchase and refund the amount paid. Vertical Unit will provide information about replacement or equivalent products, if available.

PROVISIONS

Inspect your goods carefully on receipt of the shipment to make sure the products are undamaged and correct. If your product is damaged in transit, whether the damage is visible or concealed, report this to the carrier as quickly as possible. If you find that an item is damaged or does not match what you ordered, contact us within 30 days of receipt.

Please send complaints to our customer service via the contact page. Please state the order number and the reason for the complaint. The same applies to returns. For all types of return, it is extremely important that the product is packed so that it cannot be damaged in transit. Vertical Unit has the right to replace faulty goods with goods of the same type. If the item has been discontinued, you will receive a full refund. If a returned product shows no faults or defects, Vertical Unit will send the product back.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyrights, in the website and in the material published on it are the property of Vertical Unit, its subsidiaries or licensors. Any use of the website or its content, including copying or storing such content in whole or in part, other than for your own personal, non-commercial use, is prohibited without the permission of Vertical Unit. The website vertical-unit.com may contain user-generated content from social media applications. Vertical Unit claims no rights to such content and accepts no legal responsibility for it. If you suspect an infringement of copyright or any other right, please contact our customer service.

GOVERNING LAW AND JURISDICTION

These terms and the use of the website vertical-unit.com are governed by Swiss law. To the extent permitted by law, the Swiss courts have exclusive jurisdiction over all disputes arising from these terms of use and your use of the website, subject to the right of Vertical Unit to bring proceedings against a user at their place of residence. Mandatory consumer protection provisions of the state of residence within the European Union remain unaffected.

CHANGES

Vertical Unit may revise these terms of use from time to time. Each time you order a product from us, the contract between you and Vertical Unit is governed by the general terms and conditions in force at that time. Please therefore check this page regularly.

LIFETIME WARRANTY AGAINST LENS BREAKAGE

KW Enterprises guarantees that the lenses of Vertical Unit ski goggles will not break under normal conditions of use. Breakage is defined as a complete crack or break of the lens into two or more separate pieces. For a warranty claim, a photo of the broken lens together with the original invoice or proof of purchase is sufficient; the defective lens does not need to be sent in. Intentional destruction of the lens is not covered. If the warranty claim is accepted as valid, KW Enterprises will provide a replacement lens or a new goggle. This warranty covers only breakage of the lens and expressly excludes scratches, damage to the coating and breakage of other parts, except for manufacturing defects. It applies to the first purchaser and is not transferable. The full terms are on the Warranty page.
