These Terms of Use apply to purchases made on vertical-unit.com and your use of our website. Vertical Unit is a registered trademark of KW Enterprises GmbH, a Swiss company with registration number CHE-394.242.670 (referred to as "Vertical Unit").

CONFIRMATION

Once we receive your order, we will send you an electronic invoice to your email address as confirmation of your purchase. It is important that you enter the correct email address when placing your order. We recommend that you save this email to facilitate contact with customer service in the future. The order confirmation (receipt) also serves as a guarantee of proof of purchase.

PAYMENT

You can pay with credit or debit cards as well as PayPal. Vertical Unit does not store credit card numbers. Pay securely over the internet with your Visa, AMEX or MasterCard. There is no surcharge for card payments, but if no payment is received after submitting your order, Vertical Unit may automatically cancel your order. All products remain the property of Vertical Unit until paid in full.

PROMO CODES

Promo codes should be entered during the checkout process to be valid. Attempting to add a promo code after purchase will not be honored.

STEER

All prices shown on the website are inclusive of VAT in accordance with current legislation. In case an order is shipped to a delivery address outside Switzerland or Lichtenstein, please note that VAT will be removed at checkout or earlier, depending on the country the product is delivered to. Please note that in case of an order shipped to a delivery address outside Switzerland or Lichtenstein, import duties and taxes may apply, which will be collected upon arrival of the shipment at your delivery address. You are responsible for paying such import duties and taxes. It should be noted that Vertical Unit has no control over these charges and since these charges vary by country, Vertical Unit cannot predict their amount. Vertical Unit recommends that you contact your local customs office for more information.

AN ORDER

Vertical Unit reserves the right to change prices, correct incorrect prices on all orders, as well as the final sale. If a price is incorrect, this may result in Vertical Unit canceling the purchase and refunding the amount paid in the best way. Consumers have the right to return the order within 30 days of receiving the order. The right only applies in the event that the product and its original packaging can be returned in the condition in which it is found upon receipt. If consumers exercise their right to return an order, they should contact Vertical Unit to obtain an address to send the goods. Return shipping is not paid by Vertical Unit. If you live in a geographical area where the post office does not offer returns, the customer may be required to pay for the return shipping. If an item is damaged during transport, Vertical Unit should be contacted within 30 days to obtain information about compensation.

PERSONAL DATA

When you shop at Vertical Unit, we will store some of your data to complete your purchase. Vertical Unit treats all personal data confidentially. You have the right to request access to your data and if something is not right you can have it changed or removed. Vertical Unit may also use cookies, e.g. to improve the use of the website.

PRODUCT

Vertical Unit has the right to adjust prices, impose additional costs and change product information such as product images and offers without prior notice. The available product images and information text reflect the product as closely as possible. We reserve the right to make errors that may appear on the page and cannot guarantee that all images accurately reflect the true appearance of the product. Images may vary depending on your computer's color settings.

DELIVERY AND CANCELLATIONS

Vertical Unit ships worldwide. Deliveries are made in collaboration with the post office and its partners. You have the right to cancel purchases and return delivered goods by contacting Vertical Unit's customer service within 30 days of receiving the goods or using the contact form on the Vertical Unit website, provided that the goods, including their packaging, are in the same condition as when the goods were received. However, the customer bears the risk of transporting the returned goods to Vertical Unit. In cases where you, as a customer, believe that the delivery is delayed in such a way that you no longer wish to fulfill the order, it is your responsibility to cancel the order. In cases where the order has been shipped, the customer is obliged to accept the order. The cancellation is only valid when the customer has confirmed this to Vertical Unit in writing or by email. If a product has been discontinued, Vertical Unit has the right to cancel the purchase and refund the amount paid to the customer. Vertical Unit will inform the customer of a replacement or equivalent products, if available.

PROVISIONS

It is important that you, as a customer, carefully inspect your goods/products upon receipt of your shipment to ensure that the products are not damaged and are correct. If your product is damaged in transit, regardless of whether the damage is visible or hidden, you must report this to the carrier as soon as possible. If you receive your item and find that it is damaged or does not match the one you ordered, you must also contact us within 30 days of receiving the product.

All complaints are addressed to our customer service via our contact form on the contact page. Please provide the order number and reason for the complaint and we will contact you shortly. The same applies to returns. For all types of returns, it is extremely important that the product is packaged in such a way that it cannot be damaged during transport. Vertical Unit has the right to replace faulty goods with goods of the same type. If the item has been discontinued, the customer will receive a full refund. In the event that a returned product does not have any faults or defects, Vertical Unit will return the product to the customer.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyrights, in the website and in the material published on it are owned by Vertical Unit, its affiliates or licensors. Any use of the website or its content, including copying or storing such content in whole or in part, other than for your own personal, non-commercial use, is prohibited without the permission of Vertical Unit. The website vertical-unit.com may contain user-generated content from e.g. social media applications. Vertical Unit does not claim any rights to such content (images, photos and videos etc.) and assumes no legal responsibility for it. If you suspect that there is a violation of copyright or any other right or that such content is otherwise violated, please contact our customer service.

APPLICABLE LAW AND JURISDICTION

These Terms and Use of the Website vertical-unit.com is governed by Swiss law. To the extent permitted by law, Swiss courts will have exclusive jurisdiction over any dispute arising out of these Terms of Use and your use of the Site, subject to Vertical Unit's right to prosecute a user at his or her place of residence.

CHANGES

Vertical Unit may revise these Terms of Use from time to time. Each time you order a product from us, the contract between you and Vertical Unit will be governed by the Terms and Conditions in force at that time. You should therefore visit this page regularly to review the then current Terms to which you are bound.

LIFETIME GUARANTEE AGAINST LENS BREAKAGE

KW Enterprises guarantees that the lenses of Vertical Unit ski goggles will not break under any circumstances. A break is defined as a complete crack or breakage of the lens into two or more separate pieces. In the event of a warranty claim, the defective lens must be provided to KW Enterprises for inspection. Intentional destruction of the lens is not covered. If the warranty claim is deemed valid, KW Enterprises will provide the customer with a replacement lens or a new pair of goggles. This warranty only covers breakage of the lens and expressly excludes scratches or breakage of other parts (excluding manufacturing defects). This warranty is only valid for the original customer and only upon presentation of the original invoice.
